Terms of Service

Welcome to Vylithra. These Terms of Service ("Terms") govern your access to and use of our website, mobile applications, services, and APIs (collectively, the "Platform"). By accessing or using our Platform, you agree to be bound by these Terms.

1. Account Security & Responsibilities

You are responsible for safeguarding the password that you use to access the Platform. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Prohibited Conduct & Strict Legal Action

You strictly agree NOT to engage in any of the following activities. If you are found engaging in these activities, Vylithra reserves the right to immediately terminate your account, report you to local, federal, and international law enforcement agencies, and file a civil lawsuit for damages:

  • Hacking & Exploitation: Attempting to probe, scan, or test the vulnerability of the Platform, or breaching any security or authentication measures (including DDoS attacks, SQL injection, or bypassing our Web Application Firewall). This violates the Computer Fraud and Abuse Act (CFAA) and will be criminally prosecuted.
  • Illegal Content: Uploading, sharing, or promoting content that is illegal, defamatory, threatening, pornographic, inciting violence, or violates human rights.
  • Fraud & Impersonation: Impersonating any person or entity, or using the Platform for financial fraud, money laundering, or scamming users.
  • Data Scraping: Using unauthorized bots, spiders, or automated scripts to scrape user data or platform content.

If your actions cause financial or reputational damage to Vylithra, you agree to indemnify and hold us harmless, and acknowledge that you may face civil lawsuits holding you liable for all legal fees, investigation costs, and damages.

Community Safety & Anti-Harassment Laws

1. Cyberbullying, Doxxing & Harassment

Users may not engage in targeted harassment, doxxing (publishing private or identifying information about a particular individual), stalking, or hate speech (attacks based on race, ethnicity, national origin, caste, sexual orientation, gender, gender identity, religious affiliation, age, or disability). Violators will face permanent bans and potential civil litigation.

2. Child Safety & CSAM Policy (Zero Tolerance)

Vylithra has a zero-tolerance policy for child sexual abuse material (CSAM) and the grooming or sexualization of minors. Any user found uploading, sharing, or requesting such material will have their account immediately terminated, their IP and identifying data preserved, and they will be reported to the National Center for Missing and Exploited Children (NCMEC) and local law enforcement authorities for criminal prosecution.

3. Self-Harm & Violence

We do not allow content that encourages, promotes, provides instructions on, or glorifies self-harm or suicide. Content that incites violence or organizes acts of terrorism will be reported to international intelligence and law enforcement agencies.

Financial Regulations & Fraud Prevention

Vylithra provides monetization tools for creators. The following laws govern all financial transactions on the Platform:

  • Money Laundering & Fraud: Attempting to use Vylithra for money laundering, carding (using stolen credit cards), or any financial fraud is a federal crime. We actively collaborate with payment processors (Stripe, PayPal, Razorpay) and financial crime enforcement networks to report suspicious activity.
  • Chargeback Abuse: If you fraudulently dispute legitimate charges (friendly fraud) with your bank or credit card company, your account will be permanently banned. We reserve the right to pursue civil litigation and report fraudulent chargebacks to collections agencies and credit bureaus.
  • Taxes: Creators earning revenue on Vylithra are solely responsible for calculating and paying all applicable local, state, and federal taxes on their earnings.

Privacy Policy (Google Play & App Store Compliant)

Your privacy is critically important to us. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website or use our mobile application.

1. Information We Collect

To provide you with the best experience, we collect the following types of information:

  • Personal Information: Name, email address, profile picture, and authentication data (via Google/Firebase or manual sign-up).
  • Device & Usage Data: IP address, browser type, operating system, device identifiers, and interactions with the Platform (to prevent fraud and improve UI).
  • User-Generated Content: Books, posts, reels, comments, and messages you create.
  • Permissions (Mobile App): If you use our mobile app, we may request access to your Camera and Storage (to upload photos/videos for reels/books) and Microphone (for video recording). You can revoke these permissions at any time via your device settings.

2. How We Use Your Information

We use the collected data for the following purposes:

  • To create and manage your account.
  • To deliver platform functionality (displaying your posts, books, and reels).
  • To process payments (via Razorpay/PayPal securely; we do not store full credit card numbers).
  • To detect and prevent fraudulent activity, security breaches, and illegal behavior using our Enterprise Web Application Firewall.

3. Sharing Your Information

We do not sell your personal information. We may share your information only in the following situations:

  • Service Providers: We use third-party services (e.g., Firebase, MongoDB, Vercel, Stripe) to host our database, authenticate users, and process payments. These providers are bound by strict confidentiality agreements.
  • Legal Obligations: We will disclose your information if required by law, subpoena, or if we believe such action is necessary to comply with the law and the reasonable requests of law enforcement, or to protect the security or integrity of our Platform.

4. Data Retention & Deletion

We retain your personal information only for as long as is necessary for the purposes set out in this Privacy Policy. You have the right to request the complete deletion of your account and associated data. To delete your account, visit the "Settings" page in the app/website or contact support.

Compliance Rights

GDPR (European Union)

If you are a resident of the European Economic Area (EEA), you have the right to access (Art. 15), rectify (Art. 16), erase (Art. 17), and restrict processing of (Art. 18) your personal data. CCPA (California)

Under the California Consumer Privacy Act, California residents have the right to know what personal information is collected, request its deletion, and opt-out of the sale of their information. Vylithra explicitly does not sell user data.

COPPA (Children)

Our Platform is not intended for children under the age of 13. We do not knowingly collect personal identifiable information from children under 13. If a parent or guardian believes that we have collected such data, they should contact us immediately for deletion.

Limitation of Liability & Indemnification

1. Disclaimer of Warranties

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. Vylithra expressly disclaims any warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Platform will be secure, error-free, or operate without disruption or delay.

2. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL VYLITHRA, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PLATFORM; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM; OR (III) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

3. Indemnification

You agree to defend, indemnify, and hold harmless Vylithra, its affiliates, and their respective officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Platform, or your violation of these Terms.

Dispute Resolution & Binding Arbitration

1. Agreement to Arbitrate

You and Vylithra agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, or the use of the Platform (collectively, "Disputes") will be settled by binding arbitration, except that each party retains the right to bring an individual action in small claims court and the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

2. Class Action Waiver

YOU AND VYLITHRA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and Vylithra agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.
